Terms governing access to MediaMuse AI generation services.

1. Acceptance of Terms
Welcome to MediaMuse (https://mediamuseai.com). MediaMuse is operated by an individual (referred to as "we", "us", or "our" in these Terms).
These Terms of Service ("Terms") govern your access to and use of our AI-powered software-as-a-service platform, including text-to-image, image-to-image, image tools, and related features that may be offered from time to time (the "Service").
By creating an account, subscribing to a plan, purchasing credits, checking out, or otherwise using the Service, you confirm that you:
- are at least 18 years of age;
- have read, understood, and agree to be bound by these Terms;
- agree to our Privacy Policy; and
- are authorized to enter into this agreement for yourself or any organization you represent.
If you do not agree to these Terms, do not use the Service. Continued use after we publish updated Terms constitutes acceptance of the revised Terms.
2. Service Description
2.1 What we provide
MediaMuse is a digital SaaS product delivered over the internet. After a successful purchase, credits are granted to your account and may be used to run supported AI generation tasks. Results appear in your account activity and saved assets when processing completes.
Current plans and pricing are published at /pricing.
2.2 Digital delivery
The Service is an intangible digital product. Access is provisioned promptly after payment confirmation through our merchant of record. Because delivery is immediate, refunds are limited as described in Section 7 and our Refund Policy.
2.3 Third-party AI providers
The Service relies on third-party AI model and infrastructure providers, including Kie and the underlying model vendors they use. Performance, availability, output quality, and safety controls may be affected by those providers. We do not guarantee uninterrupted access or a specific output for every request.
Generation tasks are asynchronous. Do not rely on fixed completion times.
3. Account Registration
3.1 Account creation
You must provide accurate, current information when creating an account. You are responsible for safeguarding your login credentials and for all activity under your account.
3.2 Account security
If you suspect unauthorized access, contact us promptly at support@mediamuseai.com with the subject line Security. Do not share your password with anyone. Keep your billing email address valid.
3.3 Organization accounts
If you register on behalf of a company or organization, you represent that you have authority to bind that entity to these Terms.
4. Plans and Credits
We offer subscription plans and one-time credit packs.
- Subscriptions grant credits on each billing cycle (monthly or yearly, depending on the plan purchased).
- Credit packs grant credits once at checkout and may be purchased while a subscription is active or inactive.
Paid subscription credits do not expire by default unless a specific checkout offer states otherwise. Promotional credits may have tighter limits. See our Credit Expiry Policy.
When you consume credits, credits with an earlier expiration date are used first. Among credits with the same expiration, earlier grants are used first. Promotional credits are consumed only for eligible offers and recipes described at grant time.
Separate credit packs are not canceled when a subscription ends. Their availability continues under the Credit Expiry Policy and Cancellation Policy.
We may change plan features, pricing, or available products with reasonable notice where practicable. Checkout always uses the product you select at the time of purchase.
5. Billing and Payment
5.1 Subscription auto-renewal
When you subscribe to a paid plan, you authorize us and our payment processor to charge your selected payment method at the start of each billing period until you cancel. Subscriptions renew automatically unless canceled before the renewal date.
For yearly subscriptions, we will send a renewal notice before the next charge where required or reasonably practicable.
5.2 Credit pack purchases
Each credit pack purchase is a one-time transaction authorized at checkout for the amount shown.
We do not offer automatic credit top-up at this time.
5.3 Payment processing
Payment card data is processed exclusively by our PCI-DSS compliant merchant of record, Waffo Pancake. We do not store full card numbers on our servers. Taxes, invoices, and certain payment disputes may be handled by Waffo Pancake as merchant of record.
5.4 Taxes
Listed prices are exclusive of applicable taxes unless stated otherwise. Where required by law, taxes may be calculated and collected at checkout.
6. Cancellation
You may cancel a subscription at any time:
- Online (recommended): Settings → Billing → Cancel subscription
- Email: send a cancellation request from your registered email to

Cancellation stops future renewals. Your plan usually remains active until the end of the current paid billing period unless the merchant of record states otherwise. Cancellation does not normally create a prorated cash refund for the current period.

7. Refunds
Because the Service is delivered digitally, paid amounts are generally non-refundable once credits have been granted or used, except where required by law or expressly approved by us.
We may approve refunds for duplicate charges, confirmed billing errors, or other cases described in our Refund Policy. Failed generations that never produce a usable saved asset may receive an automatic credit reversal, which is not a cash refund.
To request a billing review, contact support@mediamuseai.com within 7 days of the charge with your order number and reason. Do not include full card details.
Approved cash refunds are returned to the original payment method. Processing times depend on banks and card networks.
8. Billing Disputes
If you believe a charge is incorrect, contact us at support@mediamuseai.com with the subject line Billing before initiating a chargeback with your bank. We aim to respond within 2 business days and to resolve confirmed billing errors within 5 business days.
9. AI Content and Intellectual Property
9.1 Output ownership
Subject to these Terms and our Commercial Use Policy, you may use AI outputs generated through your account for lawful purposes, including commercial projects while on a paid plan, unless a specific offer states otherwise.
9.2 Input license
You retain ownership of prompts, source images, and other materials you submit. You grant us a limited, non-exclusive license to process that content solely to provide the Service. We do not use your inputs to train our own models without your explicit consent.
9.3 No guarantee of uniqueness
AI systems may produce similar outputs for different users. We do not guarantee exclusivity, trademark clearance, copyright registration, or freedom from third-party claims.
9.4 Accuracy disclaimer
AI outputs may be inaccurate, incomplete, outdated, or unsuitable for professional advice. Review outputs before relying on them, especially for legal, medical, financial, or safety-critical uses.
10. Acceptable Use and Content Policy
MediaMuse provides AI content generation features including text-to-image, image-to-image, image upscaling, and related tools that may be offered from time to time. This section defines our content standards, moderation practices, reporting process, and enforcement.
10.1 Scope
This policy applies to:
- Images you generate, edit, upscale, or upload
- Other media outputs you generate through the Service
- Prompts and inputs you submit to the Service
- Saved assets and outputs stored in your account
10.2 Prohibited content categories
You must not use the Service to create, request, upload, publish, or distribute content in the following six prohibited categories:
- Pornographic / NSFW content — sexually explicit material, nudity intended for arousal, or other adult content. MediaMuse is not an adult-content service.
- Violence / gore — graphic violence, gore, torture, or content that glorifies physical harm.
- Hate speech — content that attacks, dehumanizes, or incites hatred or violence against individuals or groups based on protected characteristics.
- Child-unsafe content (CSAM) — any sexual content involving minors, sexualized depictions of minors, or other child exploitation material.
- Deepfakes / impersonation — synthetic media that impersonates a real person without consent, or content intended to mislead viewers about a person's identity, statements, or actions.
- Copyright / trademark infringement — content that infringes copyrights, trademarks, trade dress, or other intellectual property without authorization.
10.3 Zero-tolerance violations
The following are zero tolerance. We may immediately suspend or terminate accounts, remove content, and report to authorities where required:
- child sexual abuse material (CSAM) or any sexual content involving minors;
- content promoting or assisting terrorism, extremist violence, or mass casualty attacks;
- instructions for manufacturing weapons of mass destruction;
- non-consensual deepfake sexual content targeting real individuals;
- content that incites genocide or systematic violence against protected groups.
10.4 Other prohibited conduct
You must not:
- violate applicable laws or regulations;
- generate abusive, harassing, defamatory, or fraudulent content;
- impersonate brands, public figures, or institutions;
- infringe privacy, publicity, or portrait rights;
- build malware, phishing material, or attack tools;
- bypass security controls, rate limits, provider safety filters, or use jailbreak prompts;
- resell or sublicense access without our prior written approval;
- scrape, systematically extract, or use outputs to train or benchmark competing AI systems without authorization;
- misrepresent AI-generated content as solely human-created professional work in regulated fields.
Free trials, promotional credits, and sample assets are for evaluation unless an offer explicitly grants broader rights. See our Commercial Use Policy.
10.5 Content moderation
We use a layered approach combining automated controls and human review:
Automated review (real time)
- Input review: prompts and uploads are evaluated before and during processing, including through Kie and underlying model provider safety systems, plus our abuse-prevention controls.
- Output review: generated outputs are subject to provider safety filters and platform checks where available.
- Abuse signals: we monitor rate limits, device and network risk signals, and abnormal usage patterns (including Cloudflare Turnstile where enabled).
Human review
- Automatically flagged content, blocked tasks, or high-risk accounts may be queued for manual review.
- User reports are reviewed by our support team.
Periodic review
- We periodically sample flagged activity and refine our controls.
Severity levels

10.6 Reporting violations
If you see content or behavior that violates this policy, report it promptly:

Include the asset or task reference, your account email, a description of the issue, and why you believe it violates this policy. Do not include unnecessary personal data about third parties.
Reporting principles: we treat reporter identity confidentially where practicable, review reports objectively, and may action malicious or repeated false reports.
10.7 Response timelines

Timelines may extend for complex cases; we will notify reporters when additional time is needed. Process: receipt → acknowledgment → triage → review → enforcement → notification where appropriate.
10.8 Enforcement
Depending on severity and history, we may:
- issue a written warning;
- remove or disable access to outputs;
- limit generation features or credit usage;
- temporarily suspend the account pending review;
- permanently terminate the account;
- report suspected illegal activity to competent authorities and cooperate with lawful requests.
10.9 Appeals
If you disagree with an enforcement action, email support@mediamuseai.com with subject line Appeal within 10 business days of our notice. Include your account email, the action you are appealing, and supporting context. We aim to complete independent review within 10 business days.
11. Data, Privacy, and Security
Your use of the Service is also governed by our Privacy Policy.
After account closure, we generally retain account data for up to 90 days before deletion, except where a longer period is required by law or needed to resolve billing, fraud, or security matters.
12. Disclaimers and Limitation of Liability
The Service is provided "as is" and "as available" without warranties of any kind, including merchantability, fitness for a particular purpose, or accuracy of AI outputs.
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability for any claim is limited to the amount you paid us in the 12 months before the event giving rise to the claim.
Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted by law.
13. Term and Termination
These Terms remain in effect while you use the Service. We may suspend or terminate access if you materially breach these Terms, engage in fraud or abuse, or where required by law.
You may close your account by contacting support@mediamuseai.com. If we terminate the Service for reasons not caused by your breach, we may provide a proportional refund of prepaid unused subscription value where required by law.
14. Governing Law and Disputes
These Terms are governed by applicable law, without regard to conflict-of-law rules.
Before starting formal proceedings, contact support@mediamuseai.com with the subject line Legal to attempt informal resolution. If a dispute cannot be resolved informally, it may be submitted to a court with competent jurisdiction.
15. General Provisions
We may update these Terms from time to time. Material changes will be announced at least 14 days before they take effect, where practicable, by updating this page and, when appropriate, by email or in-product notice.
If any provision is held invalid, the remaining provisions remain in effect. These Terms, together with the Privacy Policy, Refund Policy, Cancellation Policy, Credit Expiry Policy, and Commercial Use Policy, form the entire agreement between you and us regarding the Service.
